Ex-Source editor gets $14.5M for firing after harass charges

A federal jury in Manhattan yesterday ruled that The Source magazine and its two founders must pay $14.5 million to a former top editor who described a raunched-out workplace where executives watched porn, smoked pot and called female employees "b------."

"I feel like I've been vindicated," said Kimberly Osorio, who was canned last year. "Whether it's hip hop, rock 'n' roll or the post office, there's still laws a company needs to abide by."

The jury took just four hours to find that Osorio was fired in retaliation for complaining about sexual shenanigans at the magazine.

It also found that co-owner Raymond (Benzino) Scott defamed her during a radio interview when he accused the single mom of bed-hopping with hip-hop honchos.

"This verdict shows that all women must be treated with dignity and respect, no matter what industry they work in," said Osorio's lawyer, Kenneth Thompson.

In his closing argument, the former federal prosecutor told jurors that the "eyes of the hip-hop community are upon you" while urging them to hammer Scott and co-founder David Mays.

Thompson also replayed a vile telephone tirade in which Scott called a music journalist an "ugly butch pig" and a "slut monkey."

But an attorney for The Source - who admitted the tape hurt the magazine's case - insisted the workplace wasn't an X-rated rap video come to life.

"It's quiet, it's people working hard," said Mercedes Colwin, adding that she plans to appeal the verdict.

In her closing, Colwin admitted that four-letter words were often flung around at The Source - just not directly at Osorio.

"They used the 'f---' word, the 's---' word, the 'damn' word," she said. "It was not a gender-specific conduct whatsoever."

Osorio, 32, was formally appointed the magazine's first female editor in chief in November 2003. At a salary of $130,000, she presided over a best-selling issue that had Jay-Z on the cover before being fired in February 2005.

"She climbed to the top of the corporate ladder at The Source - only to be knocked down by men who believe women are inferior," Thompson said.

Illinois Sen. Barack Obama, a Democratic Party star, says on NBC's 'Meet the Press' yesterday that a 2008 presidential run is something he will 'sit down and consider.'
As Sen. Hillary Clinton debated her GOP rival John Spencer on ABC yesterday morning, a far greater threat to her political ambitions was looming over on NBC.
That's where Sen. Barack Obama of Illinois was saying he may run for President in 2008.

"I don't want to be corny about this. Given the response I've been getting the last several months, I have thought about the possibility," he said on "Meet the Press."

"After Nov. 7, I'll sit down and consider it."

Asked if he were abandoning his 2004 pledge to serve out a full six-year Senate term, Obama said, "That's how I was thinking at the time."

A genuine political phenomenon whose star power already rivals Clinton's, Obama would be a formidable threat in the Democratic primaries, despite - or possibly because of - his lack of government experience.

Obama, 45, is riding a wave of glowing publicity from his current book tour and is being met everywhere by adoring crowds. Oprah Winfrey urged him to run for the White House, and last week's Time magazine cover had his face next to the words "The Next President."...

F-A-B-O Involved in Shooting

Rapper Fabolous shot, stable in NYC

NEW YORK - Rapper Fabolous was shot early Tuesday as he stood at a Manhattan parking garage, spurring a sequence of events that left him both hospitalized in stable condition and under arrest, police said.

The 28-year-old rapper, whose legal name is John Jackson, was shot once in the thigh when a male with a gun approached him and three others and opened fire, police spokesman Sgt. Mike Wysokowski said.

The four jumped into a vehicle and fled, attracting the attention of police when they ran a red light. Officers stopped them and discovered two loaded guns in the vehicle, both of which were apparently unlicensed, Wysokowski said. All four men were arrested, and charges were pending.

The rapper was taken to a hospital. Police were searching for the shooter.

Police did not identify the three men arrested with the rapper, saying only that they are 18, 23 and 29 years old...

Illness Ends Usher's Chicago Run

A case of strep throat has brought an abrupt end to Usher's run in the Broadway revival of the musical Chicago, which saw a spike in ticket sales after he joined the cast.

The 27-year-old R&B star – who was playing shyster lawyer Billy Flynn for a two-month engagement – took ill on Oct. 6 and has not performed in the show since, his mother and manager, Jonnetta Patton, tells the Associated Press. He was due to give his farewell performance Saturday night.

The New York Post reports that Usher's absence has cost the production an estimated $400,000 in refunds to disappointed ticket buyers.

"Usher has had an amazing time on Broadway and loved every minute of performing on stage with the entire cast of Chicago," Patton told the AP. "He expresses his sincere apologies to all of his fans who purchased tickets to see him in Chicago this final week and appreciates all of their love and support."

Said show producer Barry Weissler: "Usher made a spectacular Broadway debut, bringing a great dedication, work ethic and his amazing talent to the show. We all hope that he might return at some point for the many fans that were unable to see his wonderful performance as Billy Flynn."

Weissler added, "Usher has found a new home on Broadway and is welcome back anytime."

Shortly after his debut in the show – for which he received strong notices from the critics – Usher told PEOPLE: "Broadway is like a monogamous relationship. Doing anything else, like acting in Hollywood – which is great – it's like a one-night stand. You do it and then you keep moving."

The role of Flynn was originally created in the 1975 production by Jerry Orbach – long before the late actor became a household name on TV's Law & Order – and later played by Richard Gere in the 2002 Oscar-winning best picture.

THE mother of rapper DMX's love child is suing the hip-hop wild man for $2 million, saying he defamed her by claiming she sexually assaulted him as he slept during their 2003 hotel one-nighter. In Sister 2 Sister magazine, DMX says Monique Wayne, who successfully sued him to establish paternity and win child support, "raped me . . . I would have been kind of heated about that [if I'd woken]. Like, yo . . . Get the [bleep] outta here." But Wayne says DMX knows their sex romp was consensual and she's suffered "severe emotional distress" as a result of his lies. DMX's rep had no comment.

October 12, 2006 -- The Source magazine - the so-called "Bible" of the hip-hop industry - is more like Sodom and Gomorrah, with racy pictures on full display, porn-video viewings in the company mailroom, and locker-room lewdness at business meetings, according to a new lawsuit.

So hostile and sexist was the environment at the magazine that The Source's first female editor, Kimberly Osorio, was forced to leave, but not before leveling charges that she was sexually harassed, verbally abused and threatened with physical violence.

In opening arguments in U.S. District Court in Manhattan, lawyers for Osorio claimed the mag's executives ignored her harassment complaints, then fired her when she refused to rescind her accusations.

This occurred, the lawyers said, after the execs undermined her leadership, berated her in front of subordinates and accused her of sleeping with industry power brokers.

"Her bosses looked down on women and treated them as inferior," said Osorio's lawyer, Kenneth Thompson, a former federal prosecutor.

The main source of her discomfort, Thompson said, was Raymond "Benzino" Scott, a co-owner of the magazine who is also a rap artist.

Thompson said Scott pressed Osorio to reveal details about her sex life, and tried to pressure her into accompanying him on a trip to Atlantic City.

"We would be great together," Scott said, according to Thompson. "I would be the king and you would be the queen of The Source."

"She said 'No,' over and over and over to Mr. Scott, [who] would not listen," Thompson said.

Lawyers for Scott and The Source said Osorio's dismissal in February 2005 had nothing to do with her complaint.

They said she was terminated because she missed deadlines and worked poorly with staffers, and they claimed her harassment charges were just legal leverage to protect her job or force a financial settlement.

"There was lots of criticism about her job during the time she worked there," said Mercedes Colwin, a Source attorney.

"She was elevated beyond her capabilities. This case is all about a hatched plan when she discovered her job was on the line."

If the magazine were so anti-women, Colwin said, managers would have never promoted her up the ladder.

The jury heard from The Source's former vice president of marketing, Michelle Joyce, who testified about pictures of topless women on bulletin boards and a porn-movie viewing in the company mailroom.

She said one employee even had a computer-screen display featuring a collage of naked and scantily clad women.

Joyce had filed a similar harassment complaint last year, but it was dismissed on legal grounds. She is appealing. Joyce admitted to the jury that she lied to the company about her college education.

So, I had a VERY disappointing weekend. I was supposed to see Usher perform in the Broadway production of "Chicago", only to find out that he canceled the show due to illness. Now, there are reports that the "divo" may end his run on the show.





Usher -- I Feel Like Crap!

TMZ has learned that R&B star Usher is sick with the flu and has been unable to perform in the Broadway musical "Chicago." Usher, who has been playing Billy Flynn in the production since August 22, missed several shows Friday through Monday. Fans have lined the streets near the Ambassador Theater each night demanding refunds after discovering his understudy would be performing. Word has it that his doctor has ordered him to be on bed rest the remainder of the week (Wednesdays are his night off anyway) and that he may not return to the stage at all.

The singer was originally scheduled to perform through October 1, but extended his run until October 14, which is also his birthday. The shows have been sold-out for weeks and Usher is reportedly the highest paid to play the role of "Billy" in "Chicago" of all time. No word on whether he'll make up the sick days and extend his run again.

Popstar and America's Got Talent judge Brandy, 27, has fallen for Project Runway finalist Michael Knight, 28! The two hit it off after being introduced by an industry acquaintance while L.A. based Brandy was Atlanta promoting her show, says sources.

"He's the perfect gentleman and has really won her affection," says a source close to the singer. They're so smitten with each other that they're racking up frequent flyer miles. I don't know if I want to by into this one. I'm a FAITHFUL watcher of Project Runway and there is something about Michael that makes me think that Brandy wouldn't be his choice when looking for love. Hmmmm....

I'm a "Grey's Anatomy" addict, so I had to post this item about Dr. Preston (Isaiah Washington) beating Dr. McDreamy's (Patrick Dempsey) ass in real life.

For McDreamy, it's nearly lights out

They almost needed some real doctors on the set of "Grey's Anatomy" this week, according to sources who say stars Isaiah Washington and Patrick Dempsey got into a violent brawl.
Our spy at the production corroborated a National Enquirer report that a long-simmering feud boiled over on Monday when Washington (Dr. Preston) attacked Dempsey (Dr. Shepherd).

The donnybrook is said to have erupted at L.A.'s Prospect Studios when Washington, 43, and Dempsey, 40, started arguing over cast members being late for a scene.

According to The Enquirer's source, the unscripted drama played out like this:

"What are we waiting on?" said Isaiah.

"Not me," said Patrick. "I'm always ready."

"At that point," said the source, "Isaiah said something mean to T.R. Knight" (who plays mild-mannered Dr. George O'Malley).

"That's when Patrick told Isaiah, 'Pick on somebody your own size.'

"Well, that did it. Isaiah became enraged and grabbed Patrick by the throat and shoved him back a few feet.

"Dr. McDreamy [Dempsey's nickname] almost landed in McDreamland."

When Knight demanded that the pair break it up, the source says, "Isaiah called him a bitch. Isaiah stormed off to his trailer to cool off, while Patrick and T.R. stood there in disbelief.

"The director and producers got involved, and a meeting was organized with the network execs."

Washington came back to the set, and the actors finished their scene, but feelings are still said to be raw, with neither actor offering an apology.

"Isaiah is a theater-trained actor who can't stand the whole McDreamy magazine-cover-boy furor over Patrick," says the source.

Our source denied Washington choked Dempsey, but confirmed, "Isaiah said some disgusting things. He was in Patrick's face. I think Isaiah has issues. There's an underlying jealousy. But it's not Patrick's fault. They've put a lot of pressure on him by making him the face of the show. Patrick never asked for it, but he promotes the show whole-heartedly."

Enquirer editor David Perel told us "the sourcing on this story is rock-solid."

Dempsey's spokeswoman said, "There was an argument on set. In any close-knit family, sometimes people argue. But everybody made up and went back to work."

Our calls to an ABC spokesman and publicist for Washington weren't returned.

Let's be glad there weren't any scalpels lying around.

Gun bust for rapper Jadakiss

Rap superstar Jadakiss was locked inside a Westchester County jail yesterday after getting busted on drug and gun charges in Yonkers, police said.
Jadakiss, whose real name is Jason Phillips, was arrested about 4:25 a.m. during a routine traffic stop at Elm St. and Nepperhan Ave.

Cops said they found a stolen, loaded .38-caliber revolver inside Jadakiss' vehicle, which was being driven by an ex-con. The rapper also had a small amount of marijuana, police said.

"I've never heard of him getting into trouble," said Cindy Sagastume, 17, a fan who works near the scene of the arrest. "He's real. He talks about how life really is."

Jadakiss, 31, and three pals in the car were each charged with criminal possession of a weapon and possession of stolen property. Jadakiss also was charged with marijuana possession.

A police source said the driver, Darnell Frazier, 24, of Yonkers, was "high as a kite."

Frazier was convicted in 2002 of criminally negligent homicide and released from prison last year. He stabbed a man to death after the man dissed his rapping, authorities said.

Jadakiss was ordered held pending a court appearance Tuesday. Courts are closed tomorrow for Columbus Day.

The Yonkers native is known for his raspy voice, feud with 50 Cent and lyrical claims that President Bush had a hand in the 9/11 attacks. Jadakiss was arrested two years ago when cops found two loaded guns in his car in Fayetteville, N.C.

He also ended up in the headlines last year when cops arrested four men after one of them allegedly pointed a gun at Jadakiss in Chelsea. He defended the gun-toting fan, saying his admirer had flashed the gun in a show of support.

Bobby Brown was red flagged last night while trying to enter exclusive Hollywood hotspot Hyde. The doorman completely ignored Brown as Paris Hilton made her always easy, worry-free entrance right in front of him. Bobby had some fans that were just as confused as him saying "You're Bobby Brown, don't they know who you are??" Bobby answers, "I'm not a big celebrity or they would have let me in."

We're not sure why Brown was denied entrance, but it could be one of a couple reasons. Maybe it's because he is now firmly planted on the D-list (and his impending divorce from Whitney Houston doesn't help) or maybe it's the fact that there's a warrant out for his arrest.

The warrant was issued by a Massachusetts judge Monday for failing failed to appear at a court hearing. Kim Ward, his other baby's mama, claims Brown owes her $11,000 in back child support payments. But don't expect a major takedown on Sunset Blvd.; cops can't pick Brown up in California, the warrant's only valid in Massachusetts. Source:TMZ.com

THERE just might be a Janet Jackson and Justin Timberlake reunion sooner than anyone expected.
Insiders in Jackson's camp said she is in talks with Timberlake's people to appear together in "some sort of big, live show like the Grammys or the Oscars" as the ultimate publicity stunt.
The two have not really spoken to each other since the infamous, breast-baring Super Bowl incident in 2004 - in which, during a performance of Timberlake's song "Rock Your Body," a so-called "wardrobe malfunction" exposed Jackson's pierced right nipple on national TV, subjecting the halftime show to worldwide ridicule and costing CBS $550,000 in fines.
A reunion "will help re-boost the sales of their albums," our source added. Jackson just came out with "20 Y.O." and Timberlake with "FutureSex/LoveSounds." Spokespeople for both singers denied any knowledge of a reunion.
